The first offer for KAP - 'Uniprom' from Niksic wants Podgorica based factory

Bankruptcy management has announced a public call for sale of the former largest Montenegro based industrial giant, for the price of 52,47 million EUR, and the due date for offers is January, 8th, while public opening of offers is scheduled for January, 10th.
Montenegro Parliament has recently adopted a Law on protection of state interest in the mining metallurgy sector, which defines that the Parliament has the final call in the procedure of KAP's sale. According to this Law, bankruptcy assigned judge makes decision on the sale to a strategic investor and makes agreement of sale only after necessary approval by the Montenegro Parliament. If the Agreement is not reached, the state can become KAP's owner with approval of the Parliament.
This Law also says that KAP cannot be sold as property, but only as a company. KAP can be bought only by a strategic investor, that is a company involved in that industry sector.
KAP went into bankruptcy procedure on July, 8th, after which the Russian side lost its right to management, but all guarantees for credits have been activated in the amount of over 230 million EUR, and the debt went into Montenegro budget.
Commercial court of Montenegro proclaimed KAP's bankruptcy on October, 9th, which only prolonged the agony of the former largest Montenegro factory. Bankruptcy manager, Veselin Perisic, earlier stated that the factory's property would be offered on sale for 52,5 million EUR.
KAP's beneficiaries' claims are over 360 million EUR.
Turkish 'Toscelik' and German 'HGL group' are the main candidates for purchase of KAP's property.
