EPS: We Understand the Economy, but We Need to Act According to the Market

Elektroprivreda Srbije (EPS) understands the needs of the economy, but it is obliged to adhere to market and non-discriminatory conditions of the sale and purchase of electrical energy expressed in a transparent way in referential European exchanges, EPS says in response to the initiative of the Serbian Association of Employers to “stop the trend of the drastic increase of the price of electricity for companies”.

As EPS told Tanjug, the Energy Law, in addition to a guaranteed supply, which is defined as a supply with regulated prices of electricity, also proscribes, since 2014, the obligation of this public enterprise acting according to the market, as one of the 63 licensed suppliers, and to enter the market of electrical energy.

– By agreeing a favored “dumping” price with economic clients, we would put other suppliers in an unfavorable position as participants in the market. Such agreements are prohibited and are null and void if their aim or consequence is to limit, jeopardize or hamper the competition to a considerable extent – EPS told Tanjug.

They add that the Commission for Protection of Competition has the authorization to do a market analysis, and, considering the legal stipulations, the subject of the analysis can be whether a supplier is causing disturbances in the market of electrical energy through its business activities, speculative price lowering, or using its market power toward the purchasers, and they can penalize potential violators.


– We are waiting for the Government of Serbia’s decision in order to be able to offer better prices for the economy in the conditions of the global energy crisis in a legal way, but also to protect the principle of legality under which we operate – EPS points out.
