Government adopts new decree regulating protection of intellectual property on borders

The struggle against counterfeiters will cost companies in Serbia more in the future. The Government has recently adopted a new decree, which regulates the protection of intellectual property on the border. The keeping, the storing and other expenses arising from handling goods of dubious origin will be charged to general representatives of the “targeted” brand, the carriers of authorization. Companies then have to take those who attempted to import counterfeited goods into Serbia to court themselves and settle the expenses with them.

– Customs regulations in this area are already largely harmonized with the EU regulation, and this amendment to the Decree is another step towards full harmonization with the European standards – the Customs Administration explains.

Representatives and distributors of sports goods of renowned global producers do not oppose this decree. Sneakers, sports suits and other similar equipment are most often counterfeited and representatives say that counterfeiters need to be stopped.

Upon confiscating a suspicious shipment, customs officers will notify general representatives of where and how the goods are stored and present them with a cost estimate. The final amount depends on the length of the inspection procedure, the quantity of confiscated goods, as well as the type. All this has a bearing on how the goods are stored.


The provisions say that the goods can be kept for a maximum of ten working days from the date of the notification.

Confiscated goods are destroyed, never donated, as they are not accompanied by documentation that might confirm the validity and the quality of the product.
