Sberbank to seize Jamnica property in Slovenia and Serbia?

Jamnica, a part of the Agrokor concern system, announced through the Zagreb Stock Exchange, that Sberbank Ljubljana had initiated two enforcement procedures against the company, in Slovenia and Serbia, whereas the bank's Zagreb branch office had initiated a procedure in Serbia over the credit, the guarantees for which had been taken over by Jamnica.

As the press release says, Sberbank Ljubljana initiated two enforcement procedures, at the Commercial Court of Belgrade and the District Court of Ljubljana, due to a loan of EUR 3.28 million, a liability of Jamnica.

Furthermore, Sberbank Zagreb also initiated an enforcement procedure at the Commercial Court of Belgrade due to a loan of HRK 255.28 million (EUR 34.5 million) for which Jamnica had provided guarantees.

These court procedures are also mentioned in the monthly report by the extraordinary management of Agrokor, published last week, which says that a number of court procedures and seizure procedures have been formally initiated against Agrokor and related companies in the past period, as have three arbitration procedures in London.

The report, which covers the period from July 10 till August 10, says that the seizure procedures were initiated against Agrokor and Jamnica by Sberbank Ljubljana in Slovenia, in line with Agrokor's stakes in Mercator and Jamnica Mineralna Voda.

– The decision on the seizure was reached on July 4, 2017, and the extraordinary management filed a complaint against it in line with the procedural law. After this was recognized in Slovenia, the said seizure procedures were stopped in line with the law – Tportal reports.

They add that there are findings that Sberbank Ljubljana has requested the adoption of a temporary measure of restraint on alienation and encumbrance of the said stakes, but that no letter about the procedure regarding the request has not been received and that the extraordinary management will take all the necessary steps in case one is sent.


The extraordinary management also said in the report that the Slovenian and Croatian companies from the Sberbank Group had initiated enforcement procedures against Jamnica in Serbia, considering the company's stake in MG Mivela, as well as against Konzum, due to the company's stake in IDEA d.o.o.
