Serbia to get new law on sanitary supervision in 2017

Serbia will get a new law on sanitary supervision this year, as experts have estimated that the solutions prescribed by the current one are out of date and that their scope and content can't meet the challenges and needs of modern inspection supervision. The reason is that they were adopted in a considerably different economic-financial, social and political environment and legal system.

Sanitary supervision entails the control of production and sale of all consumer goods. It also pertains to the fulfillment of sanitary, technical and hygienic requirements of facilities, premises, devices, furniture, equipment and tools, special-purpose transportation devices and persons subject to sanitary supervision to the end of protecting population health.

Furthermore, sanitary supervision is carried out at the border and other places where customs clearance is performed on food, but also passengers, their luggage and vehicles.

More than ten years have passed since the adoption of the current Law on Sanitary Supervision, and expert and scientific positions, organizational forms of business entities and entrepreneurs have changed considerably in the meantime, whereas other laws, not in line with the said law, have also been adopted. Due to this, the new law on sanitary supervision, whose draft has already been put up for public hearing by the Ministry of Health, needs to be harmonized with the laws on biocidal products, chemicals and food safety, as well as with the Law on Higher Education and the List of Academic Ranks in the sense of defining the vocational degree for sanitary inspectors.


The new law should establish unified inspection supervision and the implementation of unified procedures and methodological guidelines in the territory of Serbia. As sanitary supervision activities are indivisible from and correlated to sanitary supervision in border areas and customs clearance spots, it is necessary to secure integrated sanitary supervision in the entirety of the state's territory. Furthermore, the new law should enable the implementation of the principle of publicity in work and inspection supervision in line with a defined plan and program, which means that all products in the Serbian market and those coming from other states are to be controlled in accordance with strict rules and without omissions of any kind.
